These Terms of Service apply to your use of coherenceliving.com.au, the Sovereignty Artists website, and to purchases made through the website.

The website is operated by Coherence Living trading as Sovereignty Artists and Coherence Living.

By using the website or purchasing a product, you agree to these Terms.

Website purpose

Sovereignty Artists provides original journals, educational resources and related materials for artists and creative practitioners.

Website information is provided for general educational and informational purposes.

Product information

We take reasonable care to describe our products accurately, including their:

• Format

• Page count

• Intended use

• Delivery method

• Price

• Licence conditions

Colours and visual presentation may vary between screens, devices and printers.

Digital products are not physical products and will not be posted unless the product page specifically states otherwise.

Orders and payment

Prices are shown in Australian dollars unless stated otherwise.

Payment must be successfully completed before access to a paid digital product is provided.

We may cancel or decline an order where:

• Payment is not authorised

• The transaction appears fraudulent

• A pricing or technical error has occurred

• The purchase breaches these Terms

• The product is unavailable

Where we cancel a paid order, we will refund the amount paid for that order.

Digital delivery

Digital products are generally delivered through a download link, confirmation page or order email.

You are responsible for:

• Providing an accurate email address

• Checking spam or junk folders

• Downloading and securely storing your purchase

• Ensuring your device can open the stated file format

Squarespace digital-product customers are ordinarily sent a download link after purchase.

Personal-use licence

Unless a product page expressly states otherwise, your purchase gives you a limited, personal, non-exclusive, non-transferable licence to use the product for your own individual creative development.

You may:

• Download the purchased file

• Save a personal copy

• Print copies for your own personal use

• Complete and annotate the journal for yourself

You may not:

• Share the digital file with another person

• Upload it to a shared drive, membership platform or public website

• Email, copy or distribute the product

• Resell, sublicense or commercially reproduce it

• Remove copyright, authorship or provenance notices

• Adapt the material into another product, course, journal or commercial service

• Use the material to train, prompt, develop or supply an artificial-intelligence or machine-learning system

• Extract or reproduce substantial parts of the architecture, text, design or artwork

Separate licences may be available for educators, organisations, facilitators or group use. Written permission must be obtained before any use beyond the personal licence.

Intellectual property

All website content and products, including text, journal architecture, frameworks, exercises, names, artwork, graphics, design and downloadable files, remain the intellectual property of their respective owner.

• Original artwork is by Ngaire Winwood, the continuing professional art name of Selearah K. Starre

• The Coherence Compass Architecture and The Coherence Artist Journals are original works developed through the JustBE Coherence Institute

Purchasing a product does not transfer copyright or ownership.

Educational nature of the resources

The journals and resources support reflection, learning and creative development.

They do not provide medical, psychological, legal, financial or other regulated professional advice.

You remain responsible for your own decisions, actions, wellbeing, business and creative practice.

Responsible use

You agree not to use the website or its products:

• Unlawfully

• Fraudulently

• To infringe intellectual-property rights

• To distribute malicious software

• To disrupt the website

• To impersonate another person

• To obtain unauthorised access to systems or information

Website availability

We aim to keep the website and digital-delivery systems available, but uninterrupted or error-free access cannot be guaranteed.

We may update, suspend or change parts of the website where reasonably necessary for maintenance, security, legal compliance or improvement.

Third-party services

The website may use or link to third-party services, including website hosting, payment processing, analytics and social-media platforms.

We are not responsible for the independent content, availability or privacy practices of third-party websites.

Refunds and consumer rights

Refund requests are governed by our Refund Policy.

Nothing in these Terms excludes, restricts or modifies rights or remedies that cannot lawfully be excluded, including applicable consumer guarantees under the Australian Consumer Law.

Limitation of liability

We may update these Terms when our products, website, business practices or legal obligations change.

The Terms applying to a purchase will ordinarily be those published when the purchase was made, except where a legal or security update must apply immediately.

Governing law

These Terms are governed by the laws of Queensland, Australia, and applicable Commonwealth laws.

This clause does not remove any rights that a consumer may have under mandatory laws applying in their location.
